TERMS AND CONDITIONS OF USE AND SALE
INTRODUCTION AND OUR FUNCTION
1.1. Company data: Hospital Policlinico La Paloma, S.A. is a company registered in the Registro Mercantil de Las Palmas de Gran Canaria (Mercantile Registry of Las Palmas de Gran Canaria), Volume 46, Book 17, Section 3, Page 141, Sheet 207, 1st registration. CIF A-35/005842.
1.3. Service: We offer an intermediation service through which you can make purchases (“Purchases”) of products/services (“Products”) to own establishments (“Establishments”) or franchises that offer the service through the website www.hospitallapaloma.com (the “Service”).
ACCESS AND CONDITIONS OF THE WEB PAGE
2.1. Web Access: Most areas of this Website are open to everyone and can be visited and accessed without the need to make a purchase and/or register your data.
2.2. Acceptance of the conditions: By accessing any part of this Website, you are accepting the Conditions of the Website. If you do not accept the terms and conditions of this Page, you can continue browsing the web, although you cannot make purchases without your previous registration.
2.3. Review of the terms: Hospital La Paloma may review the Conditions of this Website at any time, so please check the content of these conditions periodically, since you will be subject to the terms and conditions, in force, at the time you make a purchase with us.
2.4. Responsibility: It will be your sole responsibility, to carry out everything necessary to access the Website, and ensure that all people accessing the Website through your profile and/or your Internet connection know the Conditions of this Website, and comply with them.
YOUR PERSONAL SITUATION
3.1. Capacity and age of majority: When making a purchase through the website, you guarantee that:
3.1.1. You have the necessary legal capacity to enter into binding contracts, for yourself or on behalf of others (minors, disabled, etc.); and
3.1.2. is not under 18, or is legally emancipated (Article 314 of the Civil Code).
The Client expressly and without exception accepts that access and use of this website, its services and the contents of the said services takes place under your sole and exclusive responsibility.
HOW TO MAKE A PURCHASE AND HOW IT IS PROCESSED
Previous: Electronic contracting
Hospital La Paloma indicates that the purchase contracts concluded electronically with the service providers will produce all the effects provided by the legal system when the consent and other requirements necessary for its validity concur.
“Contract concluded electronically” means a contract in which the offer and acceptance are transmitted through electronic equipment with data processing and storage, connected to a telecommunications network.
The applicable legislation, in addition to all the regulations that affect the establishments in its activity, is the Organic Law 15/1999, December 13, on the Ley de Protección de Datos (LOPD) (Protection of Personal Data); Law 34/2002, of July 11, on the Ley de Servicios de la Sociedad de de la Información y del Comercio Electrónico (LSSICE) (Law on Services of the Information Society and Electronic Commerce); Law 7/1998, of April 13, on Condiciones Generales de la Contratación y el Real Decreto Legislativo (General Conditions of Contract and Royal Legislative Decree) 1/2007, of November 16, which approves the consolidated text of the Ley General para la Defensa de los Consumidores y Usuarios (General Law for the Defense of Consumers and Users) and other complementary laws, which specifically regulate contracts concluded at a distance, as well as the regulations for the development of each one.
In order to be valid, the conclusion of contracts electronically will not require the prior agreement of the parties on the use of electronic means. The contractual obligations or any information related to it, are duly written in electronic support on this website and in the contractual documentation detailed below.
The proof of the conclusion of the electronic contract and that of the obligations that originate from it shall be subject to the general rules of the legal system and, where appropriate, to what is established in the electronic signature legislation. In any case, the electronic support in which a contract concluded electronically will be admissible in court as documentary evidence, for example, the mail received from the order confirmation.
For the determination of the law applicable to electronic contracts, the provisions of the rules of private international law of the Spanish legal system shall be followed. For these purposes, it is pointed out that the Service Provider Establishments are legally established in Spain and duly registered in the Spanish Mercantile Registry in which registration is required for the acquisition of a legal persona. The service providers of the information society established in Spain will be subject to other provisions of the Spanish legal system that apply to them, depending on the activity they carry out, regardless of the use of electronic means for their implementation.
Pre-contracting, the Entity makes available to the Client in a clear, understandable and adapted to the circumstances the relevant, truthful and sufficient information about the essential characteristics of the contract, in particular about its legal and economic conditions, and of the assets or services objective of the same on the website www.hospitallapaloma.com
For this purpose, the obligations of information on the goods or services established in the rules that apply will be relevant and, in addition:
The Entity responsible for the contractual offer is Hospital La Paloma, with the identifying data expressed in General Condition 1, and the service provider is the Franchise Center adhered to and chosen by the Client at national level, and whose data is specified to the client in the contractual document validated by the client before finalising the purchase process.
All information regarding the price of products and services, including taxes and without additional expenses, is detailed in each of the Contractual Offers.
The right of withdrawal that may correspond to the Client, can be exercised within the deadlines established for that purpose, that is, 14 calendar days, expressing the unequivocal will to the Service provider. Withdrawals of offers in their entirety will only be accepted within the indicated period. No penalty will be imposed on the Client for the exercise of his right of withdrawal or waiver.
The language in which the contract is formalised as well as the previous information is Spanish.
This pre-contractual information is provided to the Client for free.
There will be no cost of using the remote communication technique when it is calculated on a basis other than the basic rate, for using the mail.
The essential characteristics of the good or service will be defined on the website www.hospitallapaloma.com before making the purchase.
There are no delivery costs, because the Client will pick up the good or service contracted in the franchised center selected by the Client himself.
The validity period of the offer and the price is published on the website www.hospitallapaloma.com/tiendaonline at the time of purchase.
A good or service of equivalent quality and price may not be provided, replacing the one requested by the consumer or user.
The payment of the goods or services purchased will be made through Card or PayPal, as well as the sending of the purchase confirmation via email.
Written confirmation of the information
The Entity makes available to the Client the General Conditions governing the contract, so that they can be stored and reproduced by them.
All this information constitutes the so-called “General Conditions of Contract” that are accepted before the purchase occurs.
In the contracts concluded through automatic devices there is consent once the acceptance is expressed.
The Entity undertakes to confirm receipt of the acceptance to the Client by any of the following means:
– Sending an acknowledgment of receipt by email and other means equivalent of electronic communication, to the address that the accepting Client has indicated, immediately or always within a 24 hours maximum period after the following receipt of acceptance.
The confirmation, by a means equivalent to that used in the contracting procedure, of the acceptance received as soon as the acceptor has completed said procedure, provided that the confirmation can be filed by its recipient.
It will be understood that acceptance and confirmation have been received when the parties to which they are addressed have proof of this.
In the event that the acceptance of the receipt is confirmed by acknowledgment of the receipt, it will be presumed that the recipient can have the aforementioned record since it has been stored on the server in which your email account is registered, or in the device used to receive communications.
It is prohibited to provide the Client with goods or services not requested by him when said supplies include a request for payment of any kind. In the event that this is done, and without prejudice to the infringement that this entails, the Client receiving such goods or services will not be obliged to return it, nor may the price be claimed. In case you decide to return it, you must not compensate for damages or demerits the good or service suffered.
The provisions of the previous paragraph will not be applicable when it is clearly evident to the Client that the unsolicited shipment was due to an error, the burden of proof corresponding to the Entity or the Franchise Center. The Client in such cases, will have the right to be compensated for the expenses and for the damages and losses caused to him.
4.1. Registration of the form:
The client has to fill in the form as the holder of data, guaranteeing the veracity and accuracy of the data provided and forcing to immediately communicate to Hospital La Paloma any alteration that they may suffer during the term of the contract. However, Hospital La Paloma has the necessary tools to detect and notify the client in the process of buying, the possible errors in the introduction of the data, to proceed with its rectification.
The customer may also start the purchase process without prior registration, although before making the payment, he must proceed to formalise said registration in the terms expressed in the previous sections.
4.2.- Creation of the request and selection of the interested items:
Once the Customer Account is activated, purchases can now be created. For this to go forward, the client must accept the General Contract Conditions.
When creating your order, the customer, in any case, expressly acknowledges:
– That he must attend to the literal description of the articles that appear on this website. In case of doubt, the client should contact Hospital La Paloma through the customer service contact email firstname.lastname@example.org.
– Having read the essential characteristics of the products that are available on the website.
– That the indicated price of the items on the web is indicative and may vary upwards or downwards depending on the promotions existing at any time and that are applicable on the day of contracting, being informed of the final price of the product included the VAT or tax that may be applicable, for acceptance or denial before making the effective purchase.
The client is obliged to verify the data provided in the form, as well as the accuracy of the items and services chosen, having to go back to the previous steps performed in the event that it detects any type of disagreement.
Purchases can be made exclusively through the official website www.hospitallapaloma.com, selecting the desired products and the purchase establishment (which will be coincident with the place of provision of the service purchased).
From the main menu the customer has the “Online Store” button, which corresponds to the home page.
Once the promotions are displayed, the user can click on the “Add to cart” button that will take him to the promotion’s record.
On the promotion page, you can perform one or two actions: 1. Buy the selected product / service. 2. Add the extra sessions to the promotion that you want, starting from the base number of sessions that the promotion entails, in which case the cost of the session will be increased over the initial price of the promotion, so that you have exact knowledge of the additional amount that represents the acquisition of the extra sessions.
Subsequently, the customer can click on “add to cart”, showing a window that will allow you to choose between confirming the purchase and making the payment, or continue shopping.
From the top right hand corner of the web, the amount and products that you have added to the cart will always be visible, this being a link that leads to the details of the request and the start of the purchase.
4.3.- Confirmation of the request and referral of the budget:
The first step of the purchase process can be seen on the right with a summary of the comprehensive requests for the promotions and the extra sessions (if any) that will be acquired and the possibility of entering a promotion code. This code is assigned by individual promotion, so if you do not have the associated promotion added to the cart, the code will not be applied. If applicable, the text indicating the discount or extra service of the coupon will appear below the promotion.
It is also possible to eliminate extra sessions and added promotions by clicking on the “delete” button.
To be able to continue with the purchase it is essential to select the center that you want to attend, for this, we give the user the choice of the province, town and center or establishments available in their location.
Only the locations that have establishments avoiding lists of empty locations will be shown.
While the fields are being selected, a map is shown with the numbered marks of the available establishments.
When the selection of the establishment is finished, the payment method must be selected, which can be of 3 types:
1.- Pay in store, this formula will only be operative in establishments that do not yet have another type of payment or are not registered in the system.
2.- Web via Card payment.
3.- Web via Paypal payment.
At this point, several circumstances may occur depending on the identification of the client:
1.- If the client exists and is identified / registered, this step will be ignored and the request will be paid directly according to the method chosen.
2.- If you are not identified/registered, two forms will be shown, one for new clients and another for existing clients. By filling in either of them in a valid way, you go to the next payment step.
If the payment is in cash, a summary of the request, the data of the center and the validation code that must be presented at the center will be shown to the client.
In case of payment with Paypal or Card, the flow of the application will be derived to the different POS of the bank or paypal, returning this a positive or negative value. In case of being positive, the client will be shown the information of the application and of the center to which he must attend with the contact information to request an appointment or present himself.
Any of these payment methods trigger a series of emails to the user and the centre informing them of the request made with the Customer, Centre and order data.
Within the user menu (upper left) the user can, once identified/logged in, view their current and past orders, in addition to being able to see their data and modify it if they wish.
Once the items have been selected or specified by the system chosen by the customer, after verifying that the items included correspond to the initial choice, the customer must validate the request by confirming the billing and delivery data, in case they were different, the same goes for customer data.
When the client confirms his order, Hospital La Paloma will acknowledge receipt of the purchase confirmation through the referral of a new email to the client, in which he will be informed:
– Any circumstances that might affect the availability of the product offering, where appropriate, the alternatives established in point 5.7.
– Of the delivery of the request in response to the availability of the product, which in no case will be more than 30 days from the acceptance and payment of the product by the customer.
– That the final contracting process is carried out with the centre or establishment where the service will be received, and the payment will be verified, either in person, by POS or PayPal, to the owner of the service.
4.4. Acceptance of budget and payment:
Once the client is satisfied with the budget sent by Hospital La Paloma, they will proceed to their acceptance and payment through the application. For this service Hospital La Paloma offers you the means of payment expressed in clause 5.
4.5. Specifications for the Realization and Collection of your purchase: First, the applicant must indicate the products he wishes to request. Detail the reference, quantity, category and store where the product was purchased.
Also specify if you want any modification in any product and its characteristics. Specify also the number of units you request of each product.
You can also indicate, if you wish, the specific establishment where you want the requested products to be picked up. To place your order you must click on the “place my order” button or similar. Please note that it is important that you review the information you enter and correct any errors before clicking on the “place my order” button since once you click on this entry, errors can no longer be corrected.
4.6. Modification or cancellation of your order: Once you have placed your order and your payment has been authorised, you cannot cancel your order or request a refund. (For more details on the cancellation of purchases see section 4.4). If you wish to modify or cancel your order, you can contact our customer service, in the terms defined in section 6.3 and they will try to contact the Establishment in order to communicate the requested changes. However, we cannot guarantee that we can contact the Establishment or that it will agree to your changes, as the order preparations might have already started.
4.7. Payment authorisation: When the payment made is not authorised, your order will not be processed or communicated to the corresponding Establishment.
4.8. Management of the request and possible rejections of the Establishment: Upon receipt of your order, Hospital La Paloma will process your request and send you by email a notification that your order has been received and that your request is in process. The request will only be rejected in case of payment refusal.
PRICE AND PAYMENT
5.1. TAXES and shipping costs: The applicable prices are those indicated on the website on the date of the request. The prices are detailed in each article and include the applicable taxes in each establishment (VAT/IGI …). Hospital La Paloma reserves the right to make, at any time and without prior notice, the modifications it deems appropriate, being able to update, even daily, items and prices.
5.2. Payment methods: Payment will be made at the end of the purchase process and will be an indispensable condition for its formalisation. In no case can payment be made later. Payment by deferred procedures such as cash on delivery, transfer or payment in store is not accepted at the time of the requested collection, except in cases where it is specified and chosen by the customer during the purchase process.
5.4. Card payments: In the contracting process the customer will have to enter their data at the time of purchase. All data provided for these purposes are encrypted to ensure maximum security and are hosted on a secure certified server following the SSL protocol.
You can pay the price of the products purchased by any of the following means:
– Debit or credit cards issued by European financial institutions of the following classes:
– Visa Electron
– Other cards according to availability in the chosen establishment.
In any case, the payment method is chosen during the purchase process on the corresponding screen. The client must notify Hospital La Paloma of any improper or fraudulent charges on the card used for purchases, by email, as soon as possible so that Hospital La Paloma can make the necessary arrangements. Suppliers or issuers of payment methods may adopt anti-fraud measures that entail the rejection of certain types of operations. Hospital La Paloma is not responsible for the application of this type of security policy.
The payment of your order occurs in real time through the Virtual POS once it has been verified that the data provided is correct. Hospital La Paloma guarantees that it will treat with total security and confidentiality the data corresponding to the means of payment used. Card data used for payment is transmitted in SSL encrypted form. This solution guarantees communication secrecy through a dialogue of encryption keys. In order to detect and avoid fraudulent operations and unnecessary damages and inconvenience to our clients, Hospital La Paloma has adopted fraud prevention measures and controls. These controls consist of the analysis of the characteristics of the purchases and their comparison with previous fraudulent operations. Sometimes, in order to ensure that it is not a fraudulent operation, Hospital La Paloma may require you to complete certain information or to provide other complementary information. The refusal to provide this information will prevent Hospital La Paloma from making the necessary checks about the authenticity of the request. In these cases, Hospital La Paloma will have the right to cancel the application due to possible fraud. Despite our attempts to improve our fraud detection systems, we cannot fully guarantee that an operation is not classified as fraudulent. In the event that you are affected and you are denied an operation incorrectly, please indicate it through the means of contact provided in these General Conditions so that we can respond to your request as soon as possible.
In addition, keep in mind that the suppliers or issuers of the payment methods used may have adopted other anti-fraud measures not controlled by Hospital La Paloma and that entail the rejection of certain types of operations. Hospital La Paloma does not control or is responsible for the damages that may be caused by the application of the policies approved by the different providers or issuers of payment means.
It is forbidden to use a means of payment owned by a third party except in the case of expressed authorisation of said third party, being the responsibility of said authorisation and assuming all damages and losses that occur to Hospital La Paloma.
When making a payment with a credit or debit card, you may be asked to show the card with which you made the payment at the time of registering at the hospital as proof of identification and to verify that the card complies with the data of the requested Receipt.
In case of making the payment by card to the agent that delivers the product, you must enter your card in the payment equipment and, if necessary, mark the pin or secret number of the same, by additionally typing the “confirm” button to finalize the payment process.
5.5. Discount coupons: A promotional coupon or code recognised by the Website and issued by Hospital La Paloma may be applied to your order, in those cases in which you are contacted by email or if it were advertised on the website itself, provided that the products are paid by credit/debit card and that the coupon does not cover the total amount of the application.
5.6. Rejected Purchases: Due to the usual banking practices, once you have made a purchase by credit or debit card and the payment has been authorised, your bank or card issuer will retain the total amount of your order. If your order is subsequently rejected by the Establishment (as set forth in section 4.4 above) or cancelled for any other reason, your bank or card issuer will not transfer the payment of the request, and instead they will release the corresponding amount back into your account. However, this can last between 3 and 5 business days (or more, depending on your bank or card issuer). You acknowledge and agree that neither we nor the corresponding Establishment are responsible for a possible delay by your bank or issuer of your card, in releasing the amount of your account.
5.7. Cash payments: The client/applicant will pay the total amount of the request to the establishment that delivers it. The establishment may check the banknotes and coins by any means, as well as reject them when the results of the verification reveal the falsity of the same.
In Hospital La Paloma we do not accept tips, as compensation of the positive assessment of the client.
DELIVERY OF THE PURCHASED SERVICE
6.1. Before finalising the purchase process and confirming it, a contract will be sent with the service provider, identifying it and specifying the rights and obligations of each party. Read it carefully and check before confirming the purchase that meets each and every one of the requirements specified therein, otherwise you will not be able to receive the contracted service.
6.2. Likewise, you will receive a descriptive email confirming the purchase made and that you must deliver it to the establishment to identify the purchase.
6.3. In any case, the establishment will ask for personal identification by ID or passport in order to prove the correspondence of the purchase data with the buyer’s persona as well as the confirmation email of the purchase.
After making the payment, you must call the centre you have chosen to request the suitability test appointment. In the centre they will indicate the steps to follow.
7.1. General: Our Customer Service team will try to solve any problem you may have with your order. You can contact our customer service through the following email: email@example.com.
7.2. Questions about the purchase: There are FAQs available to the client on the website and, in particular, in the Online shop section, available for consultation at any time. They are designed to allow you to resolve your doubts about the purchase process. However, you can contact our Customer Service through firstname.lastname@example.org.
7.3. Change or cancellation of your order: If you wish to change or cancel a purchase already made and payment has been authorised, you can contact our Customer Service (email@example.com).
7.4. Complaints or suggestions: If you are not satisfied with the quality of the order or purchase process, you should address your claim to Hospital La Paloma. If you are not satisfied with the quality of the service provided by Hospital La Paloma, you should contact the owner of the same to present your claim. If you cannot contact our Customer Service within 48 hours following the completion of your order you can do so through the email firstname.lastname@example.org.
8.1. Permitted conditions of use: You may use this website, as well as print and download extracts from it for your non-commercial personal use, as long as you respect the following rules:
8.1.1. You can not carry out fraudulent use of the Website (such as piracy or “scrapping”).

ACCESS TO SERVICE
9.1. Website availability: Although Hospital La Paloma tries to ensure that this Website is available normally twenty-four (24) hours a day, La Paloma Hospital will not be responsible if this Website is not available at any time or during any time frame.
9.2. Suspension of access: Access to this Website may be suspended temporarily and without notice.
CONTENTS AND USER CONDUCT
10.1.1. Except for the information related to your personal data (where information about credit cards is included), which is subject to the Privacy Policies of La Paloma Hospital, all content that you enter or post on this Website will be considered non-confidential and non-private (“User Content”). By including such content you acknowledge and warrant that you own or dispose of all rights thereto. You acknowledge that Hospital La Paloma will have no responsibility with respect to the said content and that we may copy, disclose, distribute, incorporate and use it in any other way including data, images, sounds, text and the rest of the elements included in it., for any commercial or non-commercial effects.
10.1.2. You represent and warrant that any User Content that you post, or add does not violate any of the restrictions contained in paragraphs 10.2 and 10.3 below.
10.2. Uer Content Policies: It is strictly prohibited to publish, post or download on or from the Website, any User Content (including Opinions) that:
– Do not comply with any applicable local, national or international law;
– It is illegal or fraudulent;
– Suppose unauthorised advertising; or
– Contain viruses or any other harmful programs.

Responsibility: You agree to hold Hospital La Paloma harmless from any loss, damage and/or claim (and other related costs) that may be incurred or claimed against us by an Establishment or third party as a result of the Opinions or the Content included in our Web in breach of any of the declarations and guarantees, agreements or restrictions established in section 9.
10.7. Disclosure to authorities and courts: La Paloma Hospital will cooperate fully with any authority that requests or requires it to reveal the identity or location of the person who has published the Opinions or content breach of sections 9.2 or 9.3 or any other applicable restriction, exempting us to the extent that the law allows it to be held responsible for any such disclosure.
